LIMITATION OF LIABILITY
In no event shall nPrint Graphix or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not nPrint Graphix has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from nPrint Graphix or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall nPrint Graphix be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.
Our office hours are 9:00am to 5:00pm CST Monday through Friday.
Once we receive the customer’s approval to move a project into production, our typical production time is 3 business days prior to the project being picked up or shipped from our facility. Problem jobs, jobs that require multiple rounds of proofs, and/or large orders may require additional processing time. Various other factors such as equipment failures, technical difficulties, large production days, or anything else outlined under the “ORDER SHIPPING AND DELIVERY” section of this document may impede on our turnaround time.
RETURNS / REFUNDS
Since all orders are customized to the customer, all sales are final. If we verify that we made an error, we will re-print the order. No refunds or credit. The customer must notify nPrint Graphix within 24 hours of order acceptance of any defects discovered in the ordered product or the claim will be denied. In order to receive a replacement the customer must return 100% of the received product within 7 business days (on their own expense) from the time when the ordered product delivery was taken. We will only take products back if there are defects or if specifications are not met as long as they are specifications that we have agreed to do on the signs. Any specifications you place during the order may not appear on your invoice. These specifications are used as a reference and NOT a sales order. A photograph of the problem is required for documentation purposes and/or for proper assessment of the problem by our customer claims team. If your package arrives damaged, we suggest reporting the damage to the delivery driver before you sign for the package and take delivery. Make sure to take photos of the damaged package as well as the damage to the product, if applicable. If we are not given proper documentation to file a claim (photos of the product AND package), the claim and reorder will be the customer’s responsibility and we cannot guarantee that you will be reimbursed for your reprint by the shipping company. We cannot guarantee any warranty on damage after the product has been installed. If a reprint is authorized and return of the product is requested, product must be returned within seven (7) business days. We reserve the right to flag your account or charge your account for the reprint if the product is not returned. This is for the sake of honesty and quality control. nPrint Graphix will not assume that a product is printed incorrectly based solely on a customer’s word and our customer claims team needs to examine the product in person to determine the cause of the print error. This is to increase our quality and to best serve our customers.
You understand that all information, data, text, photographs, graphics, messages or other materials (“Content”) are the sole responsibility of the person from which such Content originated. This means that you, and not nPrint Graphix, are entirely responsible for all content that you use from nPrint Graphix. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree to not use the Service to send, upload, post or otherwise transmit any Content that contains (i) child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile; (ii) a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail/extortion; (iii) any matter advocating or urging the violation of liberties granted to living beings by their creator; (iv) any defamatory remarks directed any individual person; or (v) any content that infringes the intellectual property rights or other proprietary rights of nPrint Graphix. Under no circumstances will nPrint Graphix be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable. Products and services are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation. You acknowledge that nPrint Graphix does not pre-screen Content, but that nPrint Graphix and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that nPrint Graphix may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of nPrint Graphix, its users and the public. In addition, nPrint Graphix does not ask for verification of the products or services you are requesting in regard to your official affiliation with the organization you are claiming to represent. We will process your order, however nPrint Graphix will not be held liable for any and everything that happens in regards to fraudulent use of products purchased. nPrint Graphix reserves the sole right to refuse to print any Content for any reason.
nPrint Graphix is based in Springfield, MO. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Springfield, MO. You agree to submit to the jurisdiction of the city of Springfield, the county of Greene, the state of Missouri and the United States of America, their courts and agree that venue in these courts is proper in any such legal action or proceeding.
Customer is fully responsible for final proof and layout approval prior to the printing process. nPrint Graphix is NOT LIABLE for errors in a final product caused by any of the following reasons: misspelling, graphics, bleeds, grammar, damaged fonts, punctuation, wrong cuts, incorrect or missing folds, die lines, crop marks, transparency, overprint, finished product size. We DO NOT make any changes on customer files without requiring an additional final approval from the customer. The minimum charge for typesetting and design is $60 per hour.
CUSTOMER SUBMITTED ARTWORK OR GRAPHICS
All images should be provided in CMYK format. Files should be created with the proper CMYK color profile on a properly calibrated computer screen for best color results. nPrint Graphix is not responsible for any color shift that occurs in color space conversions.
All artwork, designs and images must be provided in minimum of 720 DPI at 1/10 scale and CMYK color mode. nPrint Graphix is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork. nPrint Graphix will do everything in their power to make sure the prints come out as good as they can.
COLOR PROOFING & MATCHING
nPrint Graphix is not liable for color matching or ink density on screen proofs approved by the customer. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density. Application of laminate may affect or change the appearance of the printed colors. nPrint Graphix is not liable for the final color appearance of a laminated product.
PMS color matching is available upon request for no additional charge to your order. If there is a color you need completely matched, we will need to be contacted in order to do the PMS matching.
nPrint Graphix will be happy to help you cancel your order prior to printing. However, orders may be eligible for cancellation upon request via email. Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order. Orders may not be cancelled or refunded once they have been placed into production. nPrint Graphix is not responsible for any duplicated orders that are placed on our web site due to the mistakes from the customer.
Rush orders are available upon request. Additional fees will apply to a rush order. The fees and the ability to produce a rush job will depend on numerous things, including: setup time; the time of day you are placing the order; the size (sq feet) of the order, and the other orders we are producing that day. ORDER SHIPPING AND DELIVERY
nPrint Graphix will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall nPrint Graphix be liable for any consequential or damages resulting from any delay in shipment or delivery. All nPrint Graphix customers agree not to hold nPrint Graphix liable for delays in shipments caused by weather conditions, shipping company delays or any other circumstances beyond nPrint Graphix’s direct control. nPrint Graphix shipment and delivery dates are calculated based upon estimates provided by our suppliers. nPrint Graphix will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation or a refund. nPrint Graphix will not be held liable for any and all “Acts of God” which may impede on our ability to process and ship your order. Acts of God includes anything that is out of human control or prevention. This includes, but is not limited to, flooding, earthquakes, impromptu end of life for nPrint Graphix management, epidemics, plagues, tornados, hurricanes, rapid climate shift, fire, lightning strikes, or a change in the earth’s gravitational pull. In addition, nPrint Graphix will not be held responsible for any and all “Acts of Society” which may impede on our ability to process and ship your order. Acts of Society includes anything that is created by other humans that is beyond our control (of both the labor and management) and will hinder our work process. This includes, but is not limited to, acts of war, foreign invasion, acts of terrorism, heinous criminal acts (such as arson or murder), sabotage on our equipment, computers, or vehicles, bio terrorism/anthrax, labor strikes, management lockouts, being denied physical entrance to our workplace by any means (a riot, mob, motor vehicle has crashed into our building, the building is surrounded by a blockade, etc), or any changes in the local, state, federal, or global political spectrum and all legislative, executive, or judicial law enacted by these bodies that may affect our work.
nPrint Graphix can only use its own shipping account and will not use customer provided account numbers for any couriers. Orders must be shipped at whole quantities and may not be split up.
PAYMENT AND PROCESSING
nPrint Graphix will not process any order until we have received payment for it, that means that your credit card is charged when you place your order with us, not when it ships. Please understand if there are any other charges we will contact you to charge your card again either over the phone or online. We do NOT keep your credit information on hand for any reason, once it is charged it goes through our credit card processor. We keep the last 4 digits only so that you can reference the credit card you used to make your purchase. If you choose to pay via check or money order, we will wait till the check or money order clears before we process and ship your order. Until then it will remain in our system on hold.
nPrint Graphix will provide blind shipping for wholesale customers using shipping addresses provided by the customer. When a package is not delivered due to an error made by the customer in submitting the proper blind shipping address, the package is returned to the sender (wholesale customer). All responsibility for re-shipping such blind shipments is the sole responsibility of the sender (wholesale customer).
SHIPPING ERRORS & LOST PACKAGES
Lost or damaged claims can only be filed for shipments over $50.00 in value and can only be done after 30 days from package shipment. nPrint Graphix is not responsible for 3rd party shipping errors, omissions or damaged shipments.
CUSTOMER SUPPLIED INCORRECT ADDRESS
When a package is not delivered due to an error made by the customer in submitting the proper shipping address, and the package is returned to nPrint Graphix, nPrint Graphix will reship the package with the corrected address (provided by the customer) and charge an additional shipping fee for the shipment.
In the event of technical difficulties pertaining to nPrint Graphix, we can not be held liable for any technical difficulties that are the result of error on part of the hosting company, the upstream provider or the end user. End user issues including operating system faults, virus or spyware problems, browser incompatibilities are not the responsibility or problem of nPrint Graphix. We recommend that you keep all of your software and virus definitions up to date to successfully avoid any issues.
REFUSAL OF SERVICE
We reserve the right to refuse service without disclosing a reason.
nPrint Graphix is committed to protecting the privacy of our customers. We believe it is important that everyone who accesses the nPrint Graphix website understands what kind of information is or may be collected through the website, how that information is or may be collected and used, and the measures that nPrint Graphix takes to protect the integrity of any personally identifiable information that you may provide to us.
This Privacy Statement applies to data collected by nPrint Graphix through its website.
What Kind of Data and Information Does nPrint Graphix Collect?
Certain information that identifies the type of web browser and language, access times, the domain name and specific pages visited will be automatically captured whenever a visitor accesses a nPrint Graphix website. nPrint Graphix does not collect any other data or personally identifiable information unless the user provides it to us.
nPrint Graphix’s website is primarily for business-to-business purposes and transactions. A user is required to register in order to utilize the full functionality of the website. Registration requires that you provide nPrint Graphix with certain information that is potentially of a personal nature. For example, nPrint Graphix will ask you for your e-mail address, name, company name, address and telephone number. You will also be asked to create a password that, along with your e-mail address, will enable you to logon and use the nPrint Graphix website in the future. Your personally identifiable information will also be matched against any material you upload to nPrint Graphix for print fulfillment.
If you place an order, nPrint Graphix will also ask for additional information, such as a credit card number and billing address. nPrint Graphix does not store this information. Because of this, each time you order from nPrintGraphix.com you will be prompted to reenter your credit card number. The transaction page is protected through the use of encryption technology such as the Secure Socket Layer (SSL) protocol.
If you place an order and upload a data file to nPrint Graphix for print fulfillment, there may be personally identifiable information contained in this data file (e.g. a name, address, telephone number and e-mail address on a business card file). This information may be yours or that of someone else. If it belongs to someone else, we will assume that this person has authorized you to forward this data to nPrint Graphix. If you are not authorized to send such data to nPrint Graphix, you should not upload the file.
What Use Does nPrint Graphix Make Of The Information It Collects?
nPrint Graphix uses the information it collects through its website to operate and improve the website, deliver the services or carry out the transactions you have requested, administer your account and generally operate our business.
We may use the information we collect in conjunction with analytic tools to help us determine the level of services and products we offer, improve the ease of use of our sites or services (such as by remembering information you have already entered), enhance our customer service, and to display content that can be tailored to specific customer interests, preferences and/or market segments.
nPrint Graphix does not support third-party advertising on its website, however, nPrint Graphix may promote nPrint Graphix products, services, special promotions, new features, etc., on the websites and we may use some of the information we collect in order to personalize the promotions that may appear when you access our site. The ads that you may receive may be selected based on your membership, product categories previously ordered, pages you have viewed and links you have clicked when using the nPrint Graphix website.
The personal information collected on the nPrint Graphix website may also be used to directly communicate with you. Your e-mail, mailing and/or billing address may be used for welcome letters, order confirmation, upload confirmation, job status updates, billing information and reminders, and technical service issues. nPrint Graphix may also occasionally send you product or customer service surveys, or promotional correspondence to inform you of other products or services available from nPrint Graphix.
Information contained in data files uploaded to nPrint Graphix for print fulfillment is received and stored by nPrint Graphix, but we do not use this information for any purpose other than fulfilling the requested print job.
nPrint Graphix Does Not Share Your Personal Information.
Except for the limited nPrint Graphix-related purposes described in this Statement, your personally identifiable information is not disclosed outside of nPrint Graphix. We do not sell, rent or lease your name, billing or mailing address, e-mail address, phone number or other personally identifiable information to others.
Some personally identifiable information that you provide to nPrint Graphix must necessarily be disclosed outside of nPrint Graphix in order for us to provide our services to you. For example, to ship an order we must disclose the shipping information required by the carrier. nPrint Graphix may also retain third parties to provided limited services on our behalf, such as hosting websites, programming development, transaction processing, or performing statistical analysis of our service offerings. Under certain circumstances, these third party companies may need or be given access to personally identifiable information in order to deliver their services to nPrint Graphix. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.
We may access and/or disclose your personal information if we believe such action is necessary to: (a) comply with the law or any legal process served on nPrint Graphix; (b) respond to authorized requests of governmental or law enforcement agencies; (c) protect and defend the rights or property of nPrint Graphix (including the enforcement of our agreements); and/or (d) act in urgent circumstances to protect the personal safety of users of nPrint Graphix services or members of the public.
Circumstances may arise when, for business purposes, nPrint Graphix may decide to sell, merge, acquire or otherwise reorganize its business. Any such transaction may involve the disclosure and/or receipt of personally identifiable information to or from a prospective buyer, seller, merger partner, etc. For these types of transactions, nPrint Graphix will seek appropriate protection for any personally identifiable information subject to disclosure.
The Security of Your Personal Information.
nPrint Graphix uses a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access, which are located in controlled facilities. Please note that we do not regard any of the information provided to us in data files uploaded to us for print fulfillment as sensitive information requiring encryption.
When you register with nPrint Graphix the password you choose is only as effective as you make it. It is your responsibility to choose an appropriate password and to keep it confidential. You should not share this information with anyone, and you should always log out of a nPrint Graphix website or service before leaving your computer to protect against others being able to access your information. If you believe your password has been compromised in any way you should immediately change it by logging on and following the instructions or by calling nPrint Graphix’s Customer Service for assistance.
Accessing Your Personal Information.
You may have the ability to view online the personal information that you provide to nPrint Graphix. To prevent your personal information from being viewed by others, you will be required to sign in with your e-mail address and password to gain access to your account information.
If your account information is incorrect or needs to be changed or updated, you may do so online or by calling nPrint Graphix’s Customer Service for assistance.
If you have any trouble accessing your account you may call nPrint Graphix’s Customer Service for assistance. You may be asked to provide proof of your identity before our Customer Service representatives will provide any information related to your account.
The nPrint Graphix website is primarily for business-to-business purposes and transactions and we do not intend to or knowingly collect information on, or target our services or websites to children under the age of 13. We encourage parents and guardians to be active in monitoring their children’s online activities.
Changes to This Privacy Statement.
From time to time, nPrint Graphix may update and revise this Privacy Statement to reflect changes in our policies, services and/or in response to our customers’ feedback. When we do make changes to this Privacy Statement, we will revise the “last updated” date at the top of this Statement. Because we reserve the right to modify this Privacy Statement at any time, please make sure that you review it frequently.
